§ 1 Scope of application
For the relationship between the University of Leoben/University Sports Institute (hereafter USI) and the participant in connection with the registration/payment of a USI course (several USI courses) the following General Terms and Conditions shall apply exclusively in the version valid at the time of registration. Deviating conditions of the participant are generally not accepted by the USI - unless the USI has expressly agreed to their validity in writing. By enrolling, the participant accepts the applicable General Terms and Conditions and undertakes to comply with these and the organisational instructions of the USI.
§ 2 Eligibility to enrol
Students of the MUL/another university/university of applied sciences/PÄDAK, employees and graduates of the MUL are eligible to register for the USI sports programme. Persons who have not yet reached the age of 18 must also submit a written consent to the course registration from their legal representative.
§ 3 Trying course
Trying out courses is possible after consultation with the trainers (NOT at sportshooting)
§ 4 Cancellation / Rebooking
Semester courses: Cancellation / rebooking can be made by contacting the USI ( usi(at)unileoben.ac.at ) until Fr. 27th of October 2023. The cancellation fee is € 3,00 per cancelled or exchanged course. After the cancellation deadline, cancellation or refund of the course fee is not possible.
Camps & Specials:
Cancellations can be made by contacting the USI up to three weeks before the registration deadline for each event. The cancellation fee is € 3,00 per cancelled course.
In case of cancellation after the cancellation deadline, the USI reserves the right to use the course fee or deposit as a cancellation fee (accommodation, material costs, personnel costs).
Rebooking of blocked courses (camps) is not possible. In exceptional cases (proof of accident, long-term injury or illness - medical certificate), cancellation is possible even after the cancellation deadline.
§ 5 Course Cancellations / Course Cancellation
In the event of cancellations of scheduled course dates for semester courses in excess of 30%, the course fee will be refunded on a pro rata basis as an online credit note. In the case of a (re)transfer or cash payment, the aliquot course fee will be refunded with the retention of an organisation fee.
Cancellations of up to 30% of scheduled course dates will not result in a pro rata refund of the course fee.
In case of a total cancellation, e.g. due to insufficient enrolment, the full course fee will be refunded - only in the respective semester - and the course participants will be informed of this cancellation immediately by email.
If a course is changed from face-to-face to online/alternative mode or vice versa during the current semester, there is NO entitlement to an (aliquot) refund of the course fee or course cancellation.
Cancellations or aliquot refunds cannot be granted in the event of a change in the participation requirements due to legal or official regulations, changed requirements of the Rectorate or if course units are missed due to quarantine orders.
§ 6 Disclaimer
Due to the sometimes high demands placed on the organism by the sports units, we recommend a sports medical examination. Participation is at your own discretion and in any case at your own risk. The USI is not liable for accidents, theft/damage of any kind and physical damage as a result of overexertion or an accident. This is acknowledged and accepted by enrolling in a USI course, registering for academic competitions and/or enrolling for the Uni-Fit room. The USI does not take out any accident/liability insurance. In the event of accidents and injuries, students must make use of their own health/accident/liability insurance.
If students do not have health insurance, they can use the accident and liability insurance bundle from Generali, which was taken out as part of the ÖH contribution. In the event of a claim, please contact the ÖH (Tel.: 402/8101).
We strongly recommend that staff members and graduates take out private accident/liability insurance or become members of ÖAMTC Schutzbrief, Alpenverein, Naturfreunde, ÖSV, Bergrettung, etc. - membership includes the above-mentioned insurances, rescue costs and much more.

§ 7 Checking eligibility
A legally binding course registration is only valid after payment of the course fee and receipt of the payment confirmation. The confirmation of payment handed out at the USI or printed out in the case of online registration must be presented during inspections.
Persons found in attendance are required to show identification to hall attendants and other control personnel employed by the USI.
In the event of unauthorised attendance, the control staff is authorised to demand immediate departure from the training facility. The USI reserves the right to take further measures in such cases.
For participation in online courses, an account with FIRST and LAST NAME is required. This will be checked by the course instructors.
§ 8 Prohibition of disclosure to third parties
The participant is not entitled to pass on the deposit confirmation to other persons. Misuse of any kind will result in immediate suspension from all USI courses. Course fees will not be refunded. Furthermore, the USI reserves the right to take further legal action.
§ 9 Data Protection
The USI would like to offer all its users the most attractive overall offer possible in the direction of sport, exercise and health. The protection of the privacy of each individual and the protection of personal data are of paramount importance.
Personal data (name, matr. no., address, e-mail, phone no.) are collected and processed at the USI exclusively for legally permitted purposes and to the legally defined extent. By enrolling in a USI course or registering for an academic championship (LAM/STAM/UAM), the participant agrees that the data provided may be used, stored and processed by the USI for the purposes of accounting, registration of participants, notification of any urgent matters (scheduling, course cancellations/postponements, answering questions, etc.) and the preparation of various competition reports and results lists.
The respective course instructor(s) will receive the data of their course participants for any information concerning their USI course. The data will not be passed on to third parties. They are only processed and stored for as long as is necessary for the respective purpose. The stored personal data can be deleted upon request. Further use of the USI offer is no longer possible after deletion of the personal data.
By enrolling in a USI course or registering for academic championships (LAM/STAM/UAM), the participant agrees to the publication of photos and videos taken in the course of using the University Sports Institute. They will be used for the promotion and reporting of the University Sports Institute (print and online). The consent remains valid without time limit, but can be withdrawn or restricted at any time. The withdrawal applies to all future publications, but not to those already made. Further information on data protection at Montanuniversität can be found at: dsb.unileoben.ac.at.
§ 10 Use of sports halls
Participation in sports lessons requires appropriate sports equipment. All students are requested to wear sports shoes with clean, light-coloured or abrasion-resistant (hard) soles. Hall attendants or other personnel employed by the USI are entitled to carry out checks in this respect.
§ 11 Applicable Law
Austrian law is applicable.
§ 12 Place of Jurisdiction
As far as legally permissible, the court of competent jurisdiction is the lokal one.

General Covid-19 Prevention Concept for the implementation of USI events (courses, camps and championships) at the University Sports Institute Leoben (status Feb 2022)
The University Sports Institute Leoben as a service institution of the University of Leoben will fulfil its legal duty of care for all universities at the location (§ 40 UG 2002) as far as possible also during the present crisis situation. For this purpose - on the basis of the respectively valid requirements of the government and authorities, as well as the respectively valid requirements of the University of Leoben (traffic light status) - the present concept is to be understood as a supplement to the General Terms and Conditions of the USI and thus has a binding character for all participants in USI sports. Basically, we would like to point out that with every participation in the USI sports programme, the participants are responsible for complying with the legal regulations in the COVID context as amended from time to time. The regulations at the University of Leoben can be changed at any time by decision of the rectorate.
1. In General
> All participation in the USI sports programme is on the participant's own responsibility, this also and especially applies to all persons belonging to a risk group.
> All participants are called upon and undertake to act responsibly and to always observe and support all measures that can minimise the spread of the COVID-19 virus.
> The number of participants per course will be adjusted according to the situation. Participation without registration ("taster") is not possible at the moment.
2. Prerequisite for a USI course participation/championship:
At the moment there are no "covid restrictions" - just come healthy and prepared for the course ;-)
3. Rules of conduct in the whole USI
> Symptom-free during training/competition.
> Observance of usual general hygiene measures
> Mouth-nose protection (or FFP2 mask): A mechanical protective device covering the mouth and nose area is proposed inside the building
> Bringing towels or your own material (mats etc.) is recommended.
> Ventilate the cloakrooms, training rooms as often as possible.
> Physical contact sports: Subject to the corresponding special prevention concept of the professional association or other higher-level organisations. The rules applicable at the USI are based on the respective guidelines shown on the homepage of the federal sports organisation Sport Austria ( www.sportaustria.at/de/schwerpunkte/mitgliederservice/informationen-zum-coronavirus/ ).
> USI competitions are explicitly organised as mass sport events and not as top sport events. The organisation is based on the respective valid measures, issued by the respective professional associations and shown on the homepage of the Federal Sports Organisation Sport Austria.

> Depending on the type of sport, the number of participants and the respective valid regulations, a prevention concept will be worked out separately for each championship or a COVID-19 representative will be appointed.
4. Obligations for USI instructors
> Exclusion of participants: USI instructors are obliged to exclude participants who do not appear healthy (especially in case of symptoms such as fever, flu or cough) from the event and to ask them to leave the facility
> USI trainers regularly inform participants of the measures and monitor compliance
> The course instructors undertake to ensure that only registered persons participate in the respective course (contact tracing). The lists of participants are available to the course leaders on the USI homepage
5. Communication of the preventive concept
> The USI course instructors will be familiarised with the concept directly at the USI teachers conference at the beginning of the semester and will be informed by e-mail if there are any changes to the concept. Where courses are offered by third parties, the USI will ensure that they have a prevention concept specific to the sport.
> For questions regarding the prevention concept, the USI course leaders are the first point of contact for the participants on site.
> The prevention concept will be displayed on the USI homepage and integrated into the general terms and conditions. In addition, the participants will be informed about the protective measures via the existing channels of the USI (e-mail, Facebook) or by means of a notice board.
> The applicable GTCs must be accepted with the enrolment, otherwise enrolment will not be possible.
6. Occurrence of a SARS-CoV-2 case at the USI Leoben
> If you have symptoms or fear to have contracted COVID, please stay at home and contact 1450.
> Report to the USI Leoben via the e-mail address: usi@unileoben.ac.at.
> Fill in the corresponding online form of the University of Leoben on your own:
> COVID-19 contact person at the University of Leoben informs the local health authority.
> Further steps will be ordered by the local health authority
> Testing and similar measures are carried out on the instructions of the health authority
> The USI supports the implementation of all measures as a matter of course
> Documentation by the COVID 19 contact person of the USI of which persons had contact with the person concerned and the type of contact, based on the presence lists. If necessary, the necessary data is passed on to the competent health authority.
If a case of illness is confirmed, further measures (e.g. disinfection of the sports facility) are taken on the instructions of the health authority.
